Why Your Broker Asks You to Sign a Buyer Representation Agreement (and Why It's Good for You)

If you have called a real estate broker recently to see a house and been told, "Before we go look, we need to sign a buyer representation agreement," you are not alone in wondering what changed. It is a new step, it is required, and once you understand it, most buyers realize it is one of the best things to happen to home buyers in a long time. Here is what it is, why it exists, and why Rise Above Realty thinks it is good for you.

What Changed

Two things happened close together. In 2024, a nationwide legal settlement involving the National Association of REALTORS® changed the rules for how brokers work with buyers, and as of August 2024, REALTORS® nationwide must have a written agreement with a buyer before touring a home with them. Then Oregon went a step further and put it into state law. Oregon House Bill 4058 took effect on January 1, 2025, and it requires every licensed Oregon broker to have a written buyer representation agreement in place before, or as soon as practical after, they begin helping a buyer find or purchase property.

In plain English: before a broker shows you homes, you and the broker put your working relationship in writing. That is it. What the Agreement Actually Says

A buyer representation agreement is not fine print designed to trap you. Oregon law requires it to spell out, clearly, the things you would want to know anyway:

  • What your broker owes you. The agreement describes the legal duties a buyer's agent has to you under Oregon law: loyalty, honesty, disclosure of material facts, confidentiality, reasonable care, and accounting for your money. These are real obligations, and now they are in writing with your name on them.
  • Who you are working with. The broker's license number and their supervising principal broker's contact information, so you always know who is accountable.
  • What you are looking for. A description of the kind of property and area you want help with.
  • How long it lasts. Agreements can run no longer than 24 months, and many are much shorter. You can agree to a week for a single trip to the coast, or a year for a patient search.
  • Whether it is exclusive. Oregon allows nonexclusive agreements. You are not required to promise to work with only one broker.
  • How your broker is paid. Compensation is stated plainly and it is negotiable. The agreement explains how the broker may be paid, and in many transactions the seller still offers to cover some or all of the buyer's broker fee, which is handled in the purchase offer.
  • How to end it. Both you and the broker have the right to terminate the agreement. If the relationship is not working, you are not stuck.

Why This Is a Good Thing for You

You know exactly who is on your side. For years, buyers would ride around with an agent for weeks without ever being clear about whether that agent actually represented them, what that meant, or who was paying them. Now it is spelled out before the first showing. Your broker is your advocate, in writing, from day one.

Nothing about money is hidden. The old system often left buyers unsure how their agent was being paid, or by whom. Under the new rules, you see the compensation in black and white before you commit to anything, and you have the right to negotiate it. Transparency about money is always in the consumer's favor.

You get a broker who is committed to you. When a broker signs an agreement to represent you, they are taking on real legal responsibility. In our experience, that raises the level of service. The relationship is professional from the start, expectations are clear on both sides, and there are no surprises at the closing table.

It protects you from mixed loyalties. On the North Coast, the same broker may list homes and work with buyers. The agreement, along with Oregon's agency disclosure, makes clear whose interests are being represented in every situation, so you are never left guessing.

You stay in control. You choose the length, you choose whether it is exclusive, you can negotiate the terms, and you can end it. The agreement gives you rights, not just the broker.

A Few Common Questions

Do I need one to go to an open house? No. You can walk through an open house on your own without any agreement. If you then want help making an offer on that home or any other, that is when the written agreement comes in.

What if I just want to see one house? That is fine. Agreements can be written for a single property or a single day. Tell your broker what you want and the agreement can match it.

Does signing mean I have to buy something? No. It is an agreement about how you and your broker will work together, not a promise to purchase.

What if I am relocating from out of state? The agreement can be signed electronically before you ever drive out, so your first day on the coast is spent looking at homes rather than paperwork.
